In the letter , Masimo aver that U.S. Customs and Border Protection ( CBP ) decide that Apple ’s redesign fall outside the scope of the International Trade Commission ’s ( ITC ) import ban on the two devices .
It added that Apple had explained that its “ redesign Watch products definitively do not arrest pulse oximetry functionality . ”
A decision from the U.S. Federal Appeals Court regarding Apple ’s request to break any U.S. banning on the two smartwatch models during the appeal process could come as early as Tuesday .
Masimo said in a widely report statement on Monday that Apple ’s decision to remove the tool from its smartwatches was “ a confident step toward accountability , ” supply : “ It is especially important that one of the Earth ’s largest and most knock-down party respects the intellectual property right of smaller company and complies with ITC orders when it is caught infringing . ”

The profligate oxygen feature , which measures the saturation of oxygen in the user ’s cherry stemma cells , is expected to continue operate on Series 9 and Ultra 2 equipment that have already been sold , and it ’s likely to persist on sentinel sold out of doors of the U.S.
